MEDICAL CANNABIS TREATMENT AGREEMENT AND INFORMED CONSENT

(ACUERDO DE TRATAMIENTO Y CONSENTIMIENTO INFORMADO)

CLINIC: Cura Vida Cannabis Clinics (CVCC) RESPONSIBLE ENTITY: CURA VIDA CLINICS COSTA RICA LLC SOCIEDAD DE RESPONSABILIDAD LIMITADA.

  1. NATURE OF THE CLINICAL RELATIONSHIP (ROTATIONAL CARE MODEL)
  1. Clinic-Based Care:The Patient acknowledges that they are entering into a therapeutic agreement with Cura Vida Cannabis Clinics (CVCC)as a healthcare institution. The term “Physician” in this Agreement refers to any duly authorized medical professional employed by or contracted with CVCC to provide care to the Patient.
  2. Continuity of Care and Medical Team:The Patient explicitly consents to the internal rotation of their medical care among CVCC’s staff. The Patient understands that:
  3. Their attending physician may change during the course of treatment due to scheduling, specialization, or availability.
  4. All CVCC medical professionals will have access to the Patient’s internal Clinical File (Expediente Clínico) to ensure continuity of diagnosis and dosing.
  5. This Agreement remains valid and in full force regardless of which specific CVCC physician issues the prescription at any given appointment.
  1. PHARMACEUTICAL DISPENSING AND ACQUISITION
  1. Exclusive Pharmacy Access:In strict compliance with Law No. 10113(Law on Cannabis for Medical and Therapeutic Use), the Patient understands that CVCC is a medical provider, not a dispensary. The commercialization of psychoactive cannabis products is restricted exclusively to Authorized Pharmacies (Farmacias) licensed by the Ministry of Health.
  2. Prohibition on Direct Sales: The Patient acknowledges that neither CVCC nor its physicians sell medication.
  3. No Direct-to-Consumer Cultivators: The Patient understands that under Costa Rican law, cultivators and manufacturers are not authorized to sell directly to patients. The only legal point of sale is a licensed pharmacy.
  4. Sanitary Registration (Registro Sanitario):CVCC physicians prescribe only products that hold a valid Registro Sanitarioissued by the Ministry of Health. The Patient agrees to use only these registered products for this treatment plan. The use of artisanal, home-grown, or illicit market products invalidates the medical supervision provided by CVCC.
  5. Pharmacy Selection:The Patient retains the right to fill their digital prescription at the authorized pharmacy of their choice.

III. DIGITAL PRESCRIPTION SYSTEM (RECETA DIGITAL)

  1. Mandatory Digital Platform:The Patient acknowledges that, pursuant to Executive Decree No. 43725-S, all prescriptions for THC-containing products must be issued via the official Digital Prescription System(Receta Digital).
  • No Paper Prescriptions: Paper prescriptions are legally invalid for these products (except in declared national emergencies).
  1. Consent for Regulatory Transmission:The Patient grants explicit consent for the treating CVCC Physician to enter necessary clinical data (Name, ID, Diagnosis, Medication details) into the Receta Digitalplatform. The Patient understands this data is transmitted to the Ministry of Health and the Dispensing Pharmacy solely to fulfill the regulatory requirement for access to treatment.
  2. Traceability:The Patient acknowledges that the digital system tracks dispensing dates to prevent diversion. “Lost” or “stolen” medications cannot be refilled before the digital renewal date, as the system will block the transaction.
  3. DATA PRIVACY AND NON-DISCLOSURE (PRODHAB EXEMPTION)
  4. Classification as “Internal Use” Database:In accordance with Article 2 of Law No. 8968(Law on Protection of the Person Regarding the Treatment of Personal Data), the Patient’s medical record maintained by CVCC is classified as a database for Exclusively Internal Use. Its purpose is solely to facilitate direct medical treatment within the clinic.
  5. Negative Covenant on Data Transfer:To maintain this exemption and protect Patient privacy, CVCC warrants that the Patient’s personal and sensitive data will NOT be:
  • Shared with university research programs or clinical trials.
  • Transferred to external manufacturers or cultivators.
  • Sold to marketing agencies or third-party data aggregators.
  • Published in any form.
  • Scope of Internal Sharing:The Patient authorizes the sharing of their clinical data strictly withinthe CVCC secure network for the purpose of the “Rotational Care Model” described in Section I. This internal sharing ensures that any CVCC doctor treating the patient has full knowledge of their history but does not constitute a transfer to a third party under Law 8968.

III. INFORMED CONSENT AND TREATMENT RISKS

The Patient confirms understanding of the following risks associated with Cannabinoid Therapy:

  1. Drowsiness and Driving: Cannabis causes impairment. The Patient agrees NOT TO DRIVE or operate heavy machinery for at least 4 hours after inhalation or 8 hours after ingestion.
  2. Drug Interactions: The Patient agrees to disclose all other medications they are taking to the CVCC medical team to prevent adverse interactions (e.g., with blood thinners or sedatives).
  3. Side Effects: Potential side effects include tachycardia, dry mouth, dizziness, anxiety, and short-term memory impairment.
  4. Pregnancy/Breastfeeding: Use is not recommended during pregnancy or breastfeeding due to potential developmental risks to the infant.
  5. Occupational Status: This prescription is a medical document but does not automatically override workplace safety policies regarding drug testing, particularly for safety-sensitive positions.
  1. PATIENT RESPONSIBILITIES AND TERMINATION
  1. Code of Conduct: The Patient agrees to treat CVCC staff and pharmacy staff with respect. Aggressive behavior regarding refill denials is grounds for dismissal.
  2. No Redistribution: The Patient agrees that the medication is for personal use only. Distribution to others is a criminal offense (Narcotráfico).
  3. Safe Storage: Medication must be kept in its original pharmacy packaging, out of reach of minors.
  4. Do Not Drive or use heavy machinery: Do not drive or use heavy machinery for at least 4 hour after consumption.

TERMINATION: CVCC reserves the right to terminate this Agreement if the Patient obtains cannabis from illegal sources, alters digital prescriptions, or violates the Code of Conduct.

  1. DIGITAL ACCEPTANCE AND LEGAL VALIDITY

By clicking “ACCEPT” (or the equivalent digital confirmation button within the CVCC App), the Patient acknowledges and confirms that: This is the person identified in the Digital Admission Form associated with this user account. You have read, understood, and agree to all of the terms, conditions, and risks described in this Agreement. This digital acceptance constitutes a binding electronic signature in accordance with Law No. 8454 (Law on Certificates, Digital Signatures and Electronic Documents), with the same validity and legal effectiveness as a handwritten signature.

 

ACUERDO DE TRATAMIENTO CON CANNABIS MEDICINAL Y CONSENTIMIENTO INFORMADO

CLÍNICA: Cura Vida Cannabis Clinics (CVCC) ENTIDAD RESPONSABLE: CURA VIDA CLINICS COSTA RICA LLC SOCIEDAD DE RESPONSABILIDAD LIMITADA.

  1. NATURALEZA DE LA RELACIÓN CLÍNICA (MODELO DE ATENCIÓN ROTATIVA)
  2. Atención Institucional:El Paciente reconoce que está estableciendo un acuerdo terapéutico con Cura Vida Cannabis Clinics (CVCC)como institución de salud, y no con un médico individual específico. El término “Médico” en este Acuerdo se refiere a cualquier profesional médico debidamente autorizado, empleado o contratado por CVCC para brindar atención al Paciente.
  3. Continuidad de la Atención y Equipo Médico:El Paciente consiente explícitamente la rotación interna de su atención médica entre el personal de CVCC. El Paciente comprende que:
  • Su médico tratante puede cambiar durante el curso del tratamiento debido a horarios, especialización o disponibilidad.
  • Todo el equipo médico de CVCC tendrá acceso al Expediente Clínico interno del Paciente para garantizar la continuidad del diagnóstico y la dosificación.
  • Este Acuerdo permanece válido y vigente independientemente de qué médico específico de CVCC emita la receta en una cita determinada.
  1. DISPENSACIÓN FARMACÉUTICA Y ADQUISICIÓN
  2. Acceso Exclusivo en Farmacias:En estricto cumplimiento de la Ley N.° 10113 (Ley del Cannabis para Uso Medicinal y Terapéutico), el Paciente comprende que CVCC es un proveedor médico, no un dispensario. La comercialización de productos de cannabis psicoactivo está restringida exclusivamente a Farmacias Autorizadas por el Ministerio de Salud.
  • Prohibición de Venta Directa: El Paciente reconoce que ni CVCC ni sus médicos venden medicamentos.
  • Sin Venta Directa del Cultivador: El Paciente entiende que, bajo la ley costarricense, los cultivadores y fabricantes no están autorizados a vender directamente a los pacientes. El único punto de venta legal es una farmacia licenciada.
  1. Registro Sanitario:Los médicos de CVCC prescriben únicamente productos que cuentan con un Registro Sanitarioválido emitido por el Ministerio de Salud. El Paciente acepta utilizar solo estos productos registrados para este plan de tratamiento. El uso de productos artesanales, de cultivo casero o del mercado ilícito invalida la supervisión médica proporcionada por CVCC.
  2. Selección de Farmacia:El Paciente conserva el derecho de surtir su receta digital en la farmacia autorizada de su elección.

III. SISTEMA DE RECETA DIGITAL

  1. Plataforma Digital Obligatoria:El Paciente reconoce que, conforme al Decreto Ejecutivo N.° 43725-S, todas las recetas de productos que contienen THC deben emitirse a través del Sistema Oficial de Receta Digital.
  • Sin Recetas de Papel: Las recetas en papel no tienen validez legal para estos productos (salvo en emergencias nacionales declaradas).
  1. Consentimiento para Transmisión Regulatoria:El Paciente otorga su consentimiento explícito para que el Médico tratante de CVCC ingrese los datos clínicos necesarios (Nombre, Cédula/Pasaporte, Diagnóstico, Detalles del Medicamento) en la plataforma de Receta Digital. El Paciente entiende que estos datos se transmiten al Ministerio de Saludy a la Farmacia Dispensadora únicamente para cumplir con el requisito regulatorio de acceso al tratamiento.
  2. Trazabilidad:El Paciente reconoce que el sistema digital rastrea las fechas de dispensación para prevenir el desvío. Los medicamentos “perdidos” o “robados” no pueden ser reemplazados antes de la fecha de renovación digital, ya que el sistema bloqueará la transacción.
  3. PRIVACIDAD DE DATOS Y NO DIVULGACIÓN (EXENCIÓN PRODHAB)
  4. Clasificación como Base de Datos de Uso Interno:De conformidad con el Artículo 2 de la Ley N.° 8968(Ley de Protección de la Persona frente al Tratamiento de sus Datos Personales), el expediente médico del Paciente mantenido por CVCC se clasifica como una base de datos para Uso Exclusivamente Interno. Su único propósito es facilitar el tratamiento médico directo dentro de la clínica.
  5. Compromiso de No Transferencia:Para mantener esta exención y proteger la privacidad del Paciente, CVCC garantiza que los datos personales y sensibles del Paciente NOserán:
  • Compartidos con programas de investigación universitaria o ensayos clínicos.
  • Transferidos a fabricantes o cultivadores externos.
  • Vendidos a agencias de marketing o agregadores de datos de terceros.
  • Publicados en ninguna forma.
  1. Alcance del Intercambio Interno:El Paciente autoriza el intercambio de sus datos clínicos estrictamente dentrode la red segura de CVCC con el propósito del “Modelo de Atención Rotativa” descrito en la Sección I. Este intercambio interno asegura que cualquier médico de CVCC que trate al paciente tenga pleno conocimiento de su historial, pero no constituye una transferencia a un tercero bajo la Ley 8968.
  2. CONSENTIMIENTO INFORMADO Y RIESGOS DEL TRATAMIENTO

El Paciente confirma comprender los siguientes riesgos asociados con la Terapia con Cannabinoides:

  1. Somnolencia y Conducción: El cannabis causa deterioro de las capacidades motoras. El Paciente acuerda NO CONDUCIR ni operar maquinaria pesada durante al menos 4 horas después de la inhalación u 8 horas después de la ingestión.
  2. Interacciones Medicamentosas: El Paciente acuerda revelar todos los otros medicamentos que está tomando al equipo médico de CVCC para prevenir interacciones adversas (ej. con anticoagulantes o sedantes).
  3. Efectos Secundarios: Los posibles efectos secundarios incluyen taquicardia, boca seca, mareos, ansiedad y deterioro de la memoria a corto plazo.
  4. Embarazo/Lactancia: No se recomienda su uso durante el embarazo o la lactancia debido a los riesgos potenciales para el desarrollo del infante.
  5. Situación Laboral: Esta receta es un documento médico, pero no anula automáticamente las políticas de seguridad laboral respecto a pruebas de drogas, particularmente para puestos sensibles a la seguridad.
  1. RESPONSABILIDADES DEL PACIENTE Y TERMINACIÓN
  1. Código de Conducta: El Paciente se compromete a tratar al personal de CVCC y al personal de farmacia con respeto. El comportamiento agresivo respecto a la denegación de recetas es motivo de despido de la clínica.
  2. No Redistribución: El Paciente acepta que el medicamento es solo para uso personal. La distribución a otros es un delito penal (Narcotráfico).
  3. Almacenamiento Seguro: El medicamento debe mantenerse en su envase original de farmacia, fuera del alcance de los menores.

TERMINACIÓN: CVCC se reserva el derecho de rescindir este Acuerdo si el Paciente obtiene cannabis de fuentes ilegales, altera recetas digitales o viola el Código de Conducta.

  1. ACEPTACIÓN DIGITAL Y VALIDEZ LEGAL

Al hacer clic en “ACEPTAR” (o el botón de confirmación digital equivalente dentro de la Aplicación de CVCC), el Paciente reconoce y confirma que:

  1. Es la persona identificada en el Formulario Digital de Admisión asociado a esta cuenta de usuario.
  2. Ha leído, comprendido y aceptado todos los términos, condiciones y riesgos descritos en este Acuerdo.
  3. Esta aceptación digital constituye una firma electrónica vinculante de conformidad con la Ley N.° 8454 (Ley de Certificados, Firmas Digitales y Documentos Electrónicos), con la misma validez y eficacia legal que una firma manuscrita.
